Terms and Conditions of Sale
The Terms and Conditions set out below apply to all transactions on the print/drawings sales section on the sibrownphoto.com website. Please read these carefully before placing your order.
I may change these terms from time to time without notice to you. Changes will apply to any orders received after the Terms and Conditions change.
Description of Goods
On this webshop I sell original drawing and prints, and mechanical reproductions of those. All are based around fell running, cycling, rock climbing and wider mountaineering. They may, or more likely may not, take these games very seriously.
The works are sold for display only. Please email contact@sibrownphoto.com to discuss publication or advertising licensing.

Prices
The price you pay is the price displayed on sibrownphoto.com at the time you place your order. I am not currently registered for UK VAT.
Errors and Omissions are excluded, i.e. I reserve the right not to send an item if I make a pricing error, in this event you will be informed as soon as possible.
Purchase and Delivery
I aim to ship all orders within 5 UK working days. Payment will be taken at the point of purchase. Delays are occasionally inevitable due to circumstances beyond my control(for instance a postal strike). If you have not received your order within 14 days of placing it, then you will be notified by email and given the opportunity to cancel the contract.
Goods are subject to availability. If I am unable to supply the goods, I will inform you of this as soon as possible.
Orders are shipped in board backed envelopes. These are recyclable.
Delivery Costs
Most pieces are sold with UK postage and packing included. A small postage charge, as shown on the website, is added for next day delivery or shipping to the rest of the EU.
Any import duties/taxes are the responsibility of you, the purchaser. Where you have refused to pay import duties/taxes and an order is returned to me, no refund will be made.
Goods are sent by Royal Mail using a signed-for service.
Delivery Times
Standard dispatch from ordering will be within 5 UK working days unless notified clearly on the website. I will notify you of dispatch by email.
Royal Mail 1st Class items may take 1-3 working days to be delivered, although the majority arrive next working day. Please allow up 7 working days for deliveries outside of the UK. Items are not considered ‘lost’ until 14 working days after dispatch.
All deliveries are sent signed for. If you will not be in, please use an alternative address, to ensure that your goods can be signed for and delivered.
Payment
Payments are processed by STRIPE. I take all reasonable precautions to keep the transaction secure. However, I cannot be held liable for any losses caused by security problems outside my control. If there is reason to suspect your details have been obtained fraudulently, I will endeavour to let you know as quickly as possible.
Please note, your card will be charged at time of placing an order. This secures your order and allows the payment system to go through its fraud screening processes.
Faulty Goods / Incomplete on Arrival
When you buy goods from a business, in law you have a number of rights as a consumer. To facilitate this, I will need to obtain evidence that goods are faulty.

I may ask for you to email a photo(phone shots are ideal as they date tag) of the fault, and/or ask for goods to be returned. I always check returned items. If a returned item is found not faulty the item will be returned to you. In this instance you will be liable for the return carriage. Once a fault has been verified, I will issue either refund or replacement at your choice.
Non-fault Returns and Refunds
In addition to your legal rights, I also allow you to return goods if you simply change your mind within 14 days, so long as you ensure:
- item is in the original packaging
- any tags are attached
- you include some paperwork to easily identify that you sent
Returning items like this is at your own expense. I recommend you reuse the original packaging and use Royal Mail signed for. Please remember proof of posting cannot be accepted as proof of receipt. I shall only refund what you paid for the item alone. It is your statutory duty to take reasonable care of the goods while in your care and while returning them.

Warranty
All goods are sold with warranty according to your statutory rights, which apply for the original purchaser only. Any claims on warranty require proof of purchase. Please contact sales@sibrownphoto.com if you have any queries.
Data Protection
The Data Protection Act 2018 applies.

Complaints
I take complaints seriously. If you feel I have genuinely fallen short of your expectations, please email on sales@sibrownphoto.com
To provide us both with an audit trail any complaint must be made in writing.
I will take note of what you have to say and respond in writing within 14 days.

The terms “sibrownohoto” & “Si Brown artist” are trading styles of Simon Brown a freelance artist based in South Yorkshire.
I operate as a sole trader.

Legal Dispute Resolution
The contract between us shall be governed by the laws of England and any dispute between us be resolved exclusively in the courts of England.
